What is a 601A provisional waiver?

A 601A provisional waiver allows certain individuals who are unlawfully present in the U.S. to apply for a waiver of their unlawful presence before they leave the U.S. for consular processing of their immigrant visa. This waiver helps reduce the time families are separated during the immigration process by allowing the person to wait in the U.S. for a decision before departing for their visa interview abroad.
