If your sponsor (the petitioner) dies during the processing of your petition, the petition is typically considered automatically revoked by USCIS.

You should also notify USCIS of the petitioner’s death as soon as possible and gather necessary documents, including a death certificate and financial documents from the substitute sponsor, to support your case.

In certain cases, USCIS may allow the petition to continue under a process called “humanitarian reinstatement,” which must be specifically requested.
