Attorney

The H-1B is a nonimmigrant (e.g., temporary) visa that is designed to allow U.S. employers to temporarily hire foreign workers in "specialty occupations", meaning in jobs that require a bachelor’s degree or higher (or its equivalent). The visa is generally used for professional positions in fields like science, technology, engineering, and science, though there are plenty of others. This visa is employer-specific, meaning you must have a job offer from a U.S. employer who will sponsor you. The statutory basis for the H-1B visa is found in 8 U.S.C. § 1101(a)(15)(H)(i)(b) if you are interested in reading more.
