I had a previous marriage-based green card. Will that affect my new application?

You can apply again for a green card through a new marriage, but USCIS will look closely at your immigration history.

USCIS will examine whether your first marriage was genuine or fraudulent a history of fraud can lead to denial or even a lifetime ban.

If your first green card was based on marriage and you divorced shortly after getting it, expect more scrutiny in your new application.

If your first green card was conditional (2 years), and you didn’t file Form I-751 to remove conditions, that could raise red flags or complicate your current case.
