My spouse and I are separated but not divorced. Can I still apply for a marriage-based green card?

You can apply, but separation may raise concerns about the marriage’s legitimacy. You must prove the marriage is bona fide and not solely for immigration purposes.

Yes, you’re still eligible, but USCIS will closely review your separation. You’ll need strong proof of a bona fide marriage. It’s wise to consult an immigration attorney.

Yes, if your marriage was entered into in good faith and you haven’t legally separated or divorced, you may still apply for a marriage-based green card.
