Does changing my employer while on an H-1B visa affect my chances of getting a green card? Are there extra steps involved?

Changing employers while on an H-1B visa doesn’t necessarily ruin your chances of getting a green card, but it can complicate things. If your I-140 has already been approved and it’s been 180 days, you can usually keep your priority date. But your new employer will need to start the green card process from scratch, which means filing a new PERM and I-140.

I’ve been through this myself, and honestly, it’s not as scary as it sounds. When I switched jobs, my new employer had to restart the green card process, but I was able to keep my priority date because my I-140 had been approved for over six months. It’s extra paperwork, but it’s doable.

depends on where you are in the green card process. If your I-485 is pending and it’s been at least 180 days, you can switch employers as long as the new job is in the same or similar field. You’ll need to file a Supplement J form to show that the new job meets the requirements
