Can I apply for a green card for my fiancée if we’re already engaged?

You must first file a fiancé(e) visa petition Form I-129F if you’re a U.S. citizen (green card holders can’t file this).

After the visa is approved, your fiancé(e) can come to the U.S. on a K-1 visa, and you must marry within 90 days.

If you are already married abroad, you should file a spousal petition instead (Form I-130).
