My B-2 visitor visa expired while I was in the U.S., but I already applied for an extension before it expired. Am I still considered legal while waiting?

Yes, as long as your extension was filed on time, you’re in a “period of authorized stay.”

You can remain until USCIS makes a decision.

If denied, you must leave immediately to avoid unlawful presence.

You shouldn't have any issues since you applied before it expired
