I’m from South Africa and currently in West Virginia on an F-1 student visa. I’ve met someone and we’re planning to get married. Can I apply for a green card after marriage, and what should I know before applying?

Yes, if you marry a U.S. citizen in good faith, you can apply for a green card through adjustment of status without leaving the U.S. Your legal entry on an F1 visa allows you to file Form I485 after submitting the marriage-based petition.

Make sure to collect strong evidence of a genuine relationship, such as joint lease agreements, photos, shared finances, or affidavits from friends. USCIS looks closely at F1 to green card transitions to rule out fraud.

After filing the application, you can also apply for a work permit and advance parole (travel authorization) while you wait. Until your work permit is approved, you must maintain your F-1 status or avoid unauthorized employment.
