I’m from Senegal and currently living in Kansas. I came here on a student visa but recently got married to a U.S. citizen. My visa is still valid, but I want to know if I can stay and apply for a marriage green card without having to leave the country. I’m also wondering if there are risks if I wait too long before applying. What steps should I be looking at?

Yes, you can apply for adjustment of status since you married a U.S. citizen while already in the country. It’s best not to delay filing.

When you apply, you’ll need to file Form I-485 along with your spouse’s I-130 petition. As long as your marriage is genuine, you don’t need to leave the U.S. to complete the process.


Waiting too long could complicate things if your student visa expires. It’s safer to begin the paperwork soon to protect your status.

The good news is that marriage to a U.S. citizen is one of the strongest paths to permanent residency.


Since you’re in Kansas, you would submit your paperwork to USCIS and may later be called for an interview. If your student visa expires before you file, you could still qualify, but it’s always better to apply while you’re in valid status.


Also, make sure you have evidence to prove your marriage is real. That part is very important for approval.
