I’m from Lithuania and currently living in Utah on an M-1 visa for a technical training program. I recently received a job offer from a local manufacturing company that’s impressed with my skills and wants to hire me full-time after I finish. I’ve heard the M-1 visa doesn’t allow the same work options as an F-1, so I’m unsure what I can legally do next. Can I transfer directly into an employment-based visa like the H-1B or do I have to leave the country first? I really want to stay and work, but I don’t want to violate anything.

The M-1 visa doesn’t allow you to work or easily transfer into another visa while inside the U.S. In most cases, you’ll have to leave and apply for an H-1B from abroad.

Unfortunately, M-1 holders are limited when it comes to post-training employment. You’ll usually need to return to Lithuania and have your employer petition for an H-1B on your behalf. It’s not an automatic transfer like with F-1 OPT.

Unlike F-1 students, M-1 visa holders don’t have a built-in path to work authorization after completing their studies. You’re generally required to return home once your program ends, and any change of status is tough from inside the U.S. If the company is serious about hiring you, they’ll need to sponsor you for an H-1B or another employment visa, and that process must usually start while you're still outside the country. Timing is everything, so plan ahead. It’s a good idea to consult with an immigration lawyer to map out the safest transition.
