I’m from France and currently living in Los Angeles on an ESTA under the Visa Waiver Program. I arrived in mid-May 2025 for a 90-day stay to visit friends, travel, and explore possible business ideas. I’ve now been here almost two months, and I’ve started having serious conversations with a U.S. partner about launching a small creative agency together. Since I didn’t enter with the intention to work or stay long-term, I’m unsure what’s legally allowed under ESTA and whether I can change my status or apply for a different visa while I’m still in the U.S. What are my legal options if I want to pursue this without violating immigration laws?

ESTA does not allow employment, business operation, or change of status while in the U.S. If you want to launch a business, you’ll need to leave before your 90 days expire and apply for a proper visa, like a B-1 for business visitors or an E-2 investor visa.

You cannot extend your ESTA stay or adjust status to another visa while still in the U.S. If you overstay, you risk being barred from future entries. It’s best to plan your departure and apply for a new visa from France.

If you’re considering a U.S. business partnership, talk to an immigration attorney about long-term options like the E-2 treaty investor visa. France qualifies for it, but you must show a substantial investment and intent to direct and develop the business.
