I'm a US citizen and want to sponsor my fiancé for a K-1 visa, but we've had a previous marriage.

If you and your fiancé have ended all previous marriages legally (by divorce, annulment, or death), you can sponsor a K-1 visa as long as both of you are now free to marry and meet all other requirements.

Previous marriages should generally not affect your ability to petition a fiancee so long as all previous marriages have legally ended (ie divorces are final). Because these fiancée petitions can sometimes be overwhelming with evidence requirements, we recommend working with an attorney to ensure you meet all evidentiary requirements and be able to bring your fiancée to the US as soon as possible.
