I was laid off while my I-485 adjustment of status is pending. Do I need to leave the U.S. immediately?

Being laid off while an I-485 is pending does not automatically require you to leave the United States. Adjustment applicants are generally allowed to remain while the case is pending, but employment-based cases depend on the continued existence of a qualifying job offer. You may be able to use job portability rules if you find a new qualifying role within a reasonable time. The key is ensuring that any new employment meets legal requirements and is properly documented.

A layoff during adjustment is unsettling, but you may still have options. USCIS considers whether you continue to intend to work in a similar position and whether the original petition remains valid. Timing matters greatly, and delays in securing new employment can complicate the case. Seeking legal advice quickly helps you determine whether portability applies or whether other strategies are needed to remain compliant.
