I entered the U.S. under the Visa Waiver Program (ESTA) and got married to a U.S. citizen. Can I still apply for a green card inside the U.S.?

Yes, marriage to a U.S. citizen allows adjustment of status, even if you entered on ESTA.

USCIS may closely examine the case to ensure there was no intent to misuse ESTA.

You can apply. There should be no issue as long as you can prove your entry was legal and you didn’t lie about your intent.

It’s important that the marriage is genuine and not just for immigration purposes.

Many people in this situation successfully adjust status, but legal help is recommended.
