I entered the U.S. legally several years ago and later overstayed my visa. Since then, I’ve been living quietly, working odd jobs, and avoiding trouble. Recently, a close family member became a U.S. citizen and wants to help me fix my status. I’m confused because I’ve heard overstaying can make things very complicated. Is it still possible to adjust my status from inside the U.S., or does the overstay automatically mean I have to leave and risk being barred from returning?

Overstaying a visa does not automatically eliminate all options, especially if you entered legally and now qualify through an immediate family relationship. In many cases, people who overstayed but had a lawful entry may still adjust status inside the U.S. without leaving. The key factors include how you entered, whether you have any criminal issues, and what category your family member qualifies under. Because unlawful presence rules can be harsh, it’s important not to leave the U.S. without legal advice.

I was in a similar situation and waited years before applying because I was afraid. What helped was getting a full legal consultation and understanding that staying put was safer than leaving.
