I am filing Form I-130 for my spouse and there is a question asking "Has anyone else ever filed a petition for the beneficiary?". My spouse previously filed Form I-140 through EB2-NIW, which is a self-petition. Given this context, should I still answer "YES" to the question about prior petitions?

It is best to answer honestly, so you should choose YES

A self-petition is still a petition

Answering NO could be seen as a lie, so I don’t think you should.

That is still a prior petition and must be disclosed.
