Entry:
I entered the United States without inspection (EWI). I did not receive parole at the border.
• Unlawful Presence:
I have 84 days of unlawful presence total.
I have NOT accumulated 180+ days.
Therefore, I understand that I do not trigger the 3- or 10-year bar if I leave.
• Current Status / History:
– I filed for asylum one week after arriving in the U.S.
– My asylum case is pending in Immigration Court (EOIR).
– My Individual Hearing is scheduled for September 2026 in San Francisco.
– Judge’s approval rate is around 67%.
– I have no criminal record, no traffic violations.
– I currently have a valid EAD and SSN.
– I pay taxes regularly.
• Marriage / I-130:
– I am married to a U.S. citizen.
– My spouse is a U.S. citizen by birth.
– We live together and have substantial evidence of a bona fide marriage.
– I filed I-130 on May 25, 2025 (187 days ago).
• Goal:
I want to adjust status inside the U.S. through the Immigration Judge (not consular processing).
I do not want to leave the U.S.
I want to file I-485 with the court once eligible.
