While handling product shipments for a long-standing business partner in the United States, I started thinking beyond short-term transactions. The New York market, in particular, looks promising, and the idea of opening a U.S. branch keeps coming up in our discussions. I am still based in Japan and want to approach this carefully without violating immigration or business laws. What immigration and visa considerations should be evaluated before expanding operations and actively managing a U.S. branch from abroad?

Business expansion alone does not grant permission to live or work in the U.S. You would need the correct visa if you plan to manage or operate the branch directly.

Many international business owners look into visa options like E-1, E-2, or L-1, depending on ownership structure and trade activity. The right choice depends on your role and the company’s setup.

It is possible to establish a U.S. entity while remaining outside the country. Immigration rules become relevant once you intend to enter the U.S. to actively work or oversee operations. Careful planning with legal and immigration professionals can help avoid costly mistakes.
