This fee is part of a presidential proclamation (“Restriction on Entry of Certain Nonimmigrant Workers”) and is intended to apply for 12 months (unless extended) to new petitions filed on or after the effective date.

The fee does not apply to existing H-1B visa holders reentering the U.S. under a valid visa, according to White House clarifications.
