What are the consequences if an employer withdraws an I-140 petition after it has already been approved?

If it’s withdrawn within 180 days of approval, the petition is invalid, and the worker loses priority date benefits.

If it’s withdrawn after 180 days, the worker keeps the priority date but loses the job offer tied to that petition.

Workers may use the approved I-140 to apply for an H-1B extension beyond the 6-year limit.

To actually get a green card, they’ll need another employer to file a new I-140, using the old priority date if eligible.
