Recently moved to Alabama from the Netherlands under the Visa Waiver Program, and I'm nearing the end of my 90-day stay. I originally came to visit my brother and help him settle into his new home, but now there's been a family emergency back home and I’m unsure how to handle it. My return flight is booked for next week, but if the emergency worsens and I need to change plans or stay longer, I don’t know what I’m allowed to do. I’ve read that extensions aren't possible under ESTA, but I want to be sure before taking any risks. What are my options in this situation?

Under the Visa Waiver Program (ESTA), you can’t extend your stay beyond 90 days or change status from within the U.S. If you overstay, even by a few days, you could face serious consequences, including a future travel ban.

If a true emergency prevents you from leaving on time, you can try contacting USCIS and requesting Satisfactory Departure, which may grant you up to 30 extra days. It’s only approved under urgent, documented circumstances, and must be requested before your authorized stay expires.

If you're uncertain about your timeline, it may be safer to leave the U.S. as planned and return later with a new ESTA authorization or different visa, depending on your future plans. This helps you avoid issues at future ports of entry.
