What if I married someone I met on a tourist visa—can I stay?

Yes, you might be able to stay, if your marriage to a U.S. citizen is genuine and you follow the proper steps to adjust your status.

U.S. immigration law allows someone who came on a tourist visa to adjust status (apply for a green card from inside the U.S.) if they marry a U.S. citizen even if they overstayed.

USCIS often applies the 90-day rule: if you marry and apply for a green card within 90 days of entering on a tourist visa, they may assume you misused the visa.

If you genuinely came as a visitor but later fell in love and married, and then decided to stay, you may still be eligible to adjust status.
