My spouse is abusive, but I have a conditional green card. What are my options?

You do not have to stay in an abusive relationship to keep your immigration status.

You can apply to remove the conditions on your green card without your spouse by filing Form I-751 with a waiver.

You may also qualify for VAWA (Violence Against Women Act) protection, which allows you to self-petition for a green card.

 You can request a waiver based on abuse (also called “battery or extreme cruelty”) even if your spouse won’t cooperate include evidence of the abuse, such as police reports, medical records, restraining orders, therapist letters, or affidavits.
