My spouse and I are applying for a marriage-based green card, but we recently separated. Will this affect my application?

If you are legally separated or divorced before final approval, your application will likely be denied.

If you prove the marriage was entered in good faith, you may be eligible for a waiver under the I-751 petition

Conditional green card holders who separate must apply for a waiver showing the marriage was genuine.

If reconciliation is possible, resuming cohabitation may help strengthen your application.
