I’ve been living in the U.S. on a tourist visa (B-2) for several months, but now I’ve received a job offer. Can I change my status to an H-1B from within the U.S.?

Yes, you can apply for a change of status from B-2 to H-1B while in the U.S., but you cannot start working until your H-1B is approved.

You must meet the requirements for the H-1B visa, including having a job offer in a specialty occupation

It is important to file your change of status application before your B-2 status expires.

If your change of status is denied, you may need to leave the U.S. and apply for the H-1B visa at a U.S. consulate abroad.
