I’m on DACA and just married a U.S. citizen. I entered the country illegally as a child—can I still adjust status, or do I need to leave the country to apply?

If you entered as a child and have DACA, you might be able to adjust your status without leaving the U.S. It’s best to talk with an immigration lawyer to see what options you have.

I think you can adjust status without leaving, but waivers might be needed if you have unlawful presence after age 18.

You'll likely need to leave the US and apply for a marriage-based green card at a US embassy or consulate in your country of origin, but you may face a re-entry bar of up to 10 years depending on when you applied for DACA, and could potentially avoid this with Form I-601A: Provisional Unlawful Presence Waiver
