I overstayed my visa but now I’m married to a U.S. citizen. Will my overstay affect my green card application?

You can still apply for a green card through a process called "adjustment of status" without leaving the U.S.

If you’re married to a U.S. citizen, your overstay is generally forgiven for green card purposes.

Even if you overstayed by months or years, marriage to a U.S. citizen protects you from the usual penalties.

You will need to file Form I-130 Petition for Alien Relative and Form I-485 Application to Adjust Status.

You'll still need to show that the marriage is real and not entered into just for immigration benefits.
