I applied for asylum and it's been over a year. Can I apply for a work permit now?

Yes, if 150 days have passed since you filed your asylum application without a decision, you can apply for a work permit (EAD).

USCIS cannot approve your work permit until your asylum case has been pending for at least 180 days.

You’ll file Form I-765 under the (c)(8) category for asylum applicants.

If you already filed for asylum more than a year ago and you haven’t received a decision, you likely qualify.

Having a work permit does not affect the outcome of your asylum case.
