Can I renew a conditional green card if my spouse won’t help?

Yes, you can file Form I-751 (Petition to Remove Conditions) on your own without your spouse’s help under a waiver.

If you are divorced, separated, or your spouse refuses to cooperate, you can request a waiver based on a good faith marriage that ended in divorce.

 If your spouse was abusive or emotionally harmful, you can file a waiver under the Violence Against Women Act (VAWA) protections even if you’re still married.

You should file Form I-751 before your conditional green card expires but even if it already expired, you may still file with a good explanation.
