My work visa allows me to stay in the U.S. for a specific employer, but I’ve been offered a better opportunity elsewhere. I’m unsure whether changing jobs could affect my legal status, especially if my new role has slightly different duties. How risky is it to change employers while on a work-based visa, and what precautions should I take?

Changing employers on a work-based visa is possible in many cases, but it requires proper filings before you begin working for the new company. Even small differences in job duties can matter. Starting work too early or assuming approval can create serious status violations.

Each visa category has its own rules. Some allow portability, while others require a completely new petition. Employers must file on your behalf, and timing is critical. Maintaining uninterrupted authorization protects your status and future applications.

I changed employers once and waited until everything was filed before moving. It delayed my start date, but it protected my status. Rushing the process can cost more in the long run.
