My spouse petitioned for me from abroad, but I am now considering marriage to another U.S. citizen. Can I switch the petition or start a new process?

You can withdraw the pending petition and start a new one with a U.S. citizen spouse. Immediate relatives of U.S. citizens have faster processing, so the new petition may move more quickly. However, it is crucial to properly withdraw the previous petition to avoid confusion or duplication, and to maintain eligibility by meeting all filing requirements for the new case.

Before changing petitions, consider how the new filing may affect your current immigration status. USCIS may review your previous applications and relationships to confirm eligibility and bona fide marriage. Legal guidance is strongly recommended to ensure the transition is handled correctly, particularly if you are in the U.S. and need to maintain lawful presence while the new petition is processed.
