My spouse and I are filing Form I-751 jointly, but our marriage has gone through a rough period, including a temporary separation. We are now back together and working on the relationship. Will this separation hurt our case, and how should we explain it?

A temporary separation does not automatically lead to denial of an I-751 petition. USCIS understands that marriages can experience challenges. What matters most is whether the marriage was entered into in good faith. You should be honest about the separation and explain it clearly in a written statement. Providing evidence of your shared life before and after the separation can help show the relationship is genuine. Trying to hide the separation could create credibility issues later.
