I’m originally from Serbia and now living in New Hampshire. I came here on a work visa, but I recently got engaged to my U.S. citizen partner. We want to get married soon, but I’m not sure whether it’s better to marry now and adjust status, or return home and apply for a visa through consular processing. What is the practical choice?

If you marry while in the U.S., you may be able to file for adjustment of status without leaving the country. This can be more convenient, but it depends on whether you entered the U.S. lawfully. If your entry was legal, this is often the smoother path.

Consular processing is an option, but it usually takes longer and requires leaving the U.S. for an interview.

The better option depends on your visa history and whether you maintained lawful status. If you’re still in valid status, adjusting here in the U.S. is usually the faster and less disruptive route.

Consular processing can work, but it adds travel, more wait time, and possible separation. It’s wise to review both options with an immigration attorney before deciding.
