I’m originally from Serbia and have been living in Utah for a while now. My temporary status is close to expiring, and I’m worried about what might happen if I can’t file an extension or change of status in time. What steps should I take immediately to protect myself, avoid unlawful presence, and make sure I don’t accidentally jeopardize future immigration options or my ability to return to the U.S.?

You should first check whether your current visa category allows extensions and file before your I-94 expires. Timely filing can protect you from accruing unlawful presence while USCIS processes your application.

If extension isn’t available, explore switching to a different status, such as a student, exchange, or work category. You must meet that category’s requirements and provide documentation supporting your eligibility and your continued purpose for staying in the U.S.

Consulting with an immigration attorney is also important because they can analyze your full history and suggest the safest path. They can help prevent errors, ensure all filings are timely, and guide you on any risks related to overstays or future visa applications.
