I’m originally from Azerbaijan and I’ve been living in Oregon for the past year on an O-1 visa because of my recognized work in science and innovation. My current employer just let me know they might not renew my contract when it ends in a few months. I’m not sure what options I have if I want to remain in the U.S. legally, especially since I’ve built strong professional and personal ties here. Can I switch to another status, or does everything depend on my employer’s sponsorship? What should someone in my situation realistically prepare for?

You’re not tied to just one employer. You can switch to another O-1 sponsor if one’s willing to petition for you. But timing is crucial, so don’t wait until the last minute.

Start networking immediately to find another company or institution that values your talents. The O-1 visa allows transfers, but the new employer must file a petition before your current status ends. If you can’t secure one in time, explore a change of status like a B-2 or even EB-2 NIW if eligible.

Losing an O-1 sponsor can be stressful, but you do have options if you plan strategically. If you’ve made significant achievements, you might qualify for a self-sponsored green card like the EB-1A or EB-2 NIW—especially if your work benefits the national interest. You can also request a change to visitor status temporarily to give yourself more time. Just be careful not to overstay or fall out of status during this transition. Consult with an immigration attorney to evaluate long-term strategies based on your credentials.
