I’m from Turkey and now living in Louisiana. I entered the U.S. without inspection about three years ago because of safety concerns back home, but I didn’t apply for asylum at the time. Recently, I was stopped for a traffic violation, and now I’ve been told that immigration authorities may begin removal proceedings against me. I’m very worried about being deported because my situation in Turkey is still dangerous. Do I still have any options to fight deportation, even though I crossed the border illegally and have been here without status all this time?

Yes, you still have options even if you entered illegally. Defensive asylum can sometimes be raised in removal proceedings. You should speak to an attorney immediately about whether you qualify.

People in your position can sometimes apply for asylum, withholding of removal, or protection under the Convention Against Torture, even if they crossed unlawfully.


The fact that you didn’t file earlier will complicate things, but it doesn’t automatically disqualify you. You’ll need to show strong evidence of the danger you’d face in Turkey.


Getting legal help right away is very important.

You’re not without hope, but deportation cases move fast. Get an immigration lawyer as soon as possible.
