I’m from the Dominican Republic, and I’ve been living in Minnesota for about a year on a visiting visa. During my stay, I met someone special, and now we’re talking seriously about marriage. But my visa will expire in a few months, and I’m worried about what happens next. Can I stay in the U.S. after marriage, or do I have to return home first before starting the immigration process?

If you marry a US citizen while your visa is still valid, you can apply for green card but if your visa expires before you file, you will become out of status and have to leave

If you marry a U.S. citizen, you can typically apply for a green card from within the United States through adjustment of status.

You don’t necessarily need to leave, but the timing of your marriage and visa expiration matters. If the marriage is genuine and not for immigration purposes, you can usually stay and apply for permanent residence. Make sure all paperwork and evidence of a bona fide relationship are ready before filing.
