I’m from Nigeria and I’m currently living in Missouri. I came here on an F-1 visa to study nursing, and I’ll be graduating at the end of this semester. I’ve already applied for Optional Practical Training (OPT), but I haven’t received my EAD card yet. A clinic just offered me a great job, and they want me to start right away. I’m not sure if I can begin working without the card, even though my application is pending. What are the legal risks if I accept the job now, and is there anything I can do to speed up the process?

You cannot legally begin working until you’ve received your EAD card. Starting early, even with a job offer could jeopardize your OPT and future immigration benefits.

The USCIS rule is clear: you must wait for the physical EAD card before working. Even unpaid work related to your field might be seen as a violation. If your OPT application has been pending too long, you can submit a service request or contact your DSO for guidance.

Even though it’s tempting to accept the offer, don’t start working until your EAD card arrives. Doing so would count as unauthorized employment and could seriously affect your immigration record, especially if you plan to apply for H-1B or a green card in the future. If your case has been pending for over 90 days, you can submit a service inquiry through the USCIS website. Your school’s DSO might also be able to escalate the issue. Until then, it’s safest to wait, even if the clinic is eager to have you.
