I’m from Japan and recently moved to Vermont. I’m considering applying for the EB-5 investor visa, but I’m worried because the business I want to invest in is a seasonal tourism lodge that only operates from May to October. Would USCIS consider this a qualifying investment for EB-5 purposes, or does the seasonal nature of the business make it harder to meet the job creation requirements?

A seasonal business can still qualify, but you must meet all EB-5 requirements for investment and job creation. The seasonal schedule itself isn’t an automatic disqualifier.

It depends on whether you can show the creation of at least 10 full-time, permanent jobs, even in a seasonal industry.

USCIS focuses on the type and duration of jobs your investment creates. While seasonal businesses can be eligible, you must still prove that the jobs are considered “permanent” under EB-5 rules. This means they should last at least two years and be full-time, even if staffed in rotation. Many seasonal operators use a combination of year-round administrative staff and seasonal workers to meet this requirement. Careful business planning is key to approval.
