I’m from Estonia and recently arrived in Texas on a Visa Waiver Program (ESTA). I’m staying with family for a few weeks, and someone told me that while I’m here, I could get a U.S. driver’s license since I’ll be renting a car for travel around the state. But I’m confused; can visitors on ESTA legally apply for a driver’s license in Texas? Will the DMV allow me to apply with just my foreign passport and ESTA details? I don’t want to do anything that could be seen as establishing residency or get in trouble with immigration later on.

You might be able to get a temporary driver’s license in Texas, but it depends on your visa status and supporting documents. ESTA travelers generally aren’t eligible for full licenses.

Texas usually requires proof of lawful presence and a longer period of stay than the 90 days ESTA allows. Some short-term visitors can get limited-term licenses, but it’s not guaranteed. It’s best to call your local DMV and ask what they accept for ESTA travelers.

Getting a driver’s license while on ESTA can be tricky, especially since the program only permits a 90-day stay. Texas DMVs usually require documentation that shows a longer legal presence, like a visa or I-94 with an extended validity. Some travelers have been issued licenses, but others have been denied due to short stay duration. You can try applying with your passport and printed I-94, but approval varies by office. Just be clear that you’re not intending to establish residency, only seeking driving privileges during your visit.
