I’m from Algeria, on a short trip to Texas on a B-2 visitor visa. I recently got engaged to a U.S. citizen. Can I get married and stay in the U.S., or do I need to leave first?

You can get married while on a B-2 visa and apply for adjustment of status (Form I-485) if the marriage is genuine and you originally entered the U.S. without immigrant intent. This allows you to stay in the U.S. while your green card application is processed.

It’s important that your original entry on the B-2 visa wasn’t with the intent to marry and stay, as that could raise issues of visa fraud. Timing matters. filing too soon after entry may lead to questions during your interview.

Once you apply for adjustment of status, you can also file for a work permit and travel authorization. While your green card is pending, you must not leave the U.S. unless you’ve received advance parole, or your application could be considered abandoned.
