I’m an Indian woman living in Connecticut on an H-4 visa while my husband works on an H-1B. I’ve been here for almost two years and I’d love to work, but I’ve heard mixed things about whether H-4 holders can actually apply for work permits. Can someone explain if it’s possible for me to get legal authorization to work, and what steps I should take?

Yes, in certain cases H-4 spouses can apply for work authorization. It’s only available if your H-1B spouse has an approved I-140 petition or has extended status beyond six years under AC21. If your husband qualifies, you can file Form I-765 for an EAD.

Not all H-4 visa holders are eligible for work permits, which is why you’ve heard conflicting answers.


The key factor is whether your husband has an approved I-140 immigrant petition or has extended H-1B status due to green card delays.


If that applies, you can file Form I-765 with USCIS and, once approved, you’ll receive an Employment Authorization Document (EAD). With that card, you can work legally for any employer in the U.S.


Without it, you cannot work on H-4.

If your husband doesn’t yet have an approved I-140 or extended status, you won’t be able to apply right now. You may need to wait until he reaches that stage.
