If my H-1B transfer is denied after my grace period ends, can I file a Motion to Reopen (MTR) and remain in the U.S. legally while waiting for the outcome? I have a new job offer, but my new employer is not cap-exempt, and they are uncertain if my H-1B transfer will be approved before my grace period ends.

Yes, you can file a Motion to Reopen (MTR) in the US, but you must do so within a specific timeframe (usually 30 days) after receiving the denial decision. However, consult with an immigration attorney to ensure you meet the eligibility criteria and follow the correct procedure

To maintain legal status while awaiting the outcome of your MTR, you may need to file a separate application for a stay of deportation or a temporary restraining order. Your immigration attorney can guide you through this process.
