I was arrested years ago but the charges were dismissed. Do I need to disclose this on my immigration application?

Yes, arrests must generally be disclosed even if the charges were dismissed or expunged. USCIS and consular officers care about the full history, not just convictions. Failing to disclose an arrest can be viewed as misrepresentation, which is often more serious than the arrest itself. You should provide certified court records showing the final outcome and be prepared to explain the circumstances clearly.

Many applicants worry that a dismissed case will harm their immigration process, but disclosure alone does not mean denial. Officers review the nature of the arrest and the resolution. Being honest and organized usually strengthens credibility. Immigration authorities often already have access to arrest records, so transparency is always the safer approach.
