I recently applied for a family-sponsored green card and noticed my priority date is not current. Can I do anything in the meantime to stay in the U.S. legally?

While waiting for your priority date to become current, maintaining a valid nonimmigrant status is critical. You cannot rely solely on the pending family petition for lawful presence unless you are an immediate relative of a U.S. citizen. Options include student visas, work visas, or other qualifying nonimmigrant categories. Planning ahead prevents gaps in status, which could complicate your eventual adjustment or visa application.

If you are already in the U.S., ensure all documentation is up to date, including visa extensions or employment authorizations. Overstaying without valid status can trigger bars to adjustment and make consular processing more difficult later. Consulting an immigration professional can help determine which statuses are available and how best to maintain lawful presence while waiting for your priority date.
