I moved to Idaho from Turkey earlier this year on a B-1/B-2 visa. My original purpose was to attend a series of family events and take care of some personal matters for a few months. Now, after spending time here, I’ve developed a genuine interest in continuing my education in the U.S. and have already identified a college in Boise offering the program I want. However, I know a tourist visa doesn’t allow me to study full-time, and I’m unsure whether I can change my status without leaving the country. What’s the correct legal process for switching from a B-2 visa to a student visa, and what risks should I be aware of?

You can apply to change your status from B-2 to F-1 from within the U.S. by filing Form I-539. However, you must remain in valid B-2 status during the entire processing period, which can take several months.

USCIS may scrutinize your intent at entry. If it looks like you entered on a tourist visa planning to study, they could deny your change of status. Waiting at least 60 days after arrival before applying helps reduce suspicion of preconceived intent.
