I have lived in the United States for many years without lawful status, and now I am in removal proceedings. Someone mentioned cancellation of removal. What are the requirements, and how difficult is it to qualify?

Cancellation of removal for nonpermanent residents requires demonstrating at least ten years of continuous physical presence in the United States, good moral character during that period, and that removal would cause exceptional and extremely unusual hardship to a qualifying U.S. citizen or lawful permanent resident spouse, parent, or child. This standard is very high and requires strong supporting evidence, including medical, financial, or educational hardship documentation.

Only a limited number of cancellation cases are approved each year, and approval is discretionary. The hardship must go beyond typical emotional or financial difficulty. Detailed documentation, affidavits, and expert reports can strengthen the case. Immigration judges evaluate the totality of circumstances, including community ties, employment history, and compliance with laws.
