I came to the US on a student visa but my program ended last year and I stayed longer than I should have. I recently got engaged to a US citizen and we want to get married soon. Will my overstay cause problems when we apply for my green card?

If you entered the US legally with inspection, many people in your situation can still apply for adjustment of status through marriage to a US citizen. An overstay by itself is usually forgiven for immediate relatives of US citizens. The key factor is proving the marriage is genuine and that the original entry was lawful. You should still speak with an immigration attorney to review your entry documents and immigration history before filing.

Overstaying a student visa does create immigration violations, but marriage to a US citizen can allow you to adjust status in many cases if you entered legally. However, if there were other issues like unauthorized employment, misrepresentation, or prior immigration violations, those could affect the case. It is best to have a lawyer review your situation and guide you through the green card process.
