I applied for OPT and my case has been pending for over three months. My job start date is coming up and my employer is asking questions. Is this delay normal and can I start working while waiting?

Unfortunately, OPT delays are very common, especially during busy seasons. You cannot start working until you receive the EAD card and the start date listed on it.

You can check processing times online and submit an inquiry if your case is outside normal timeframes. Some people also request expedited processing if they meet the criteria.

I had the same issue and my employer pushed my start date back. It was stressful, but once the EAD arrived everything was fine. Just make sure you don’t work early.
